Steps
- If the other side is unfamiliar with Chorda Two-Track, direct that person to the www.two-tracklawyers.com web site, and propose use of this approach to resolve the dispute. Any party may call (866) 842-0382 or (512) 482-0382, or email kstewart@chorda.com with questions.
- Discuss the Track 1 fees option, if appropriate (see Procedures Manual, Form 5).
- If not already done, identify Track 1 and Track 2 attorneys for each side (see Find an Attorney and Procedures Manual, Form 1).
- Track 1 attorneys sign Track 1 Participation Agreement (see Procedures Manual, Form 2).
- Track 1 attorneys and clients meet with their respective Track 2 attorneys for consultation on this case should it later be necessary to proceed to litigation or arbitration (see Procedures Manual, Form 4).
- Track 1 attorneys (and their respective clients) begin negotiations, including the option of mediation, continuing until a settlement is reached or impasse declared (see Procedures Manual, Form 3).
- If settlement, attorneys formalize agreement with appropriate documentation; if impasse, transfer case to Track 2 attorneys for arbitration or litigation. For settlement, consider adding two-track clause to agreement and/or future contracts (see Procedures Manual, Form 6).
